Booking Terms & Conditions (Eleuthera)
1 The Contract
1.1 Your contract is with Bonefish Adventure Limited. If you have any questions about it please contact us.
1.2 Any bookings made by telephone, facsimile or e-mail are on the basis of these Terms & Conditions applying, notwithstanding the booking form has not been signed by the customer.
1.3 A contract shall exist in respect of a holiday on acceptance by Bonefish Adventure Limited of the completed booking form together with the appropriate payment (see Clause 3 below).
1.4 The contract shall be governed by the law of England and the exclusive jurisdiction of the English courts shall apply.
2 Holiday Price
2.1 Unless agreed otherwise and noted on the booking form, the holiday price is that advertised in the current holiday price list at the time of booking.
2.2 Unless agreed otherwise and noted on the booking form, the price includes the accommodation, food, transport & services specified in the price list, but nothing else.
2.3 For the avoidance of doubt (and without limitation) there is not included in the price any travel insurance, fishing equipment, fuel or other motoring expenses, flights or other transport to or from the holiday location (except between the specified holiday destination airport and the accommodation at the appointed time), departure taxes, food & drink (other than the meals specified), tips and items of a personal nature.
3 Payment
3.1 A deposit of 50% of the holiday price is payable on making the booking.
3.2 The balance of the holiday price must be paid no later than 12 weeks before commencement of the holiday. We do not routinely issue reminders, therefore please make careful note of the date payment is due. If full payment is not received by us on time, we have the right to treat your booking as cancelled by you, in which event, you will be liable for cancellation charges in accordance with Clause 8 below.
3.3 Bookings made less than 12 weeks prior to commencement of the holiday must be accompanied by the full holiday price.
3.4 The person making the booking acts on behalf of all other persons named and becomes responsible for all payments in respect of that booking.
4 Surcharges
4.1 In the event of price increases arising beyond our control (e.g. exchange rate fluctuations) we reserve the right to levy a surcharge of no more than 15% of the full holiday price.
4.2 The surcharge will become payable on the same date as the balance.
4.3 No surcharge will be levied after the full holiday price has been paid to and accepted by us.
5 Accommodation
5.1 We reserve the right to alter the details of the holiday accommodation provided, if forced to do so through circumstances beyond our control.
5.2 You must pay all extra charges which you incur at the hotel/accommodation (e.g. all supplements, drinks, phone, extra food) before vacating the accommodation.
5.3 Generally, irrespective of your arrival/departure times, accommodation may not be available before 2.00 p.m. on the arrival date booked and must be vacated by 10.00 a.m. on the departure date booked.
6 Insurance
We require that you and all members of your party have comprehensive holiday insurance covering medical emergencies and cancellations. This Is your sole responsibility.
7 Flights
It is solely your responsibility to arrange flights to and from the holiday destination. We will not be held liable for your failure to arrive at the holiday destination airport, nor for any costs or consequential loss incurred as a result of delays to, or cancellations of your flights. Any costs incurred as a result of your early or late arrival or departure are your sole responsibility.
8 Cancellations
8.1 All cancellations must be received in writing immediately bearing the signature of the person who booked the holiday, or agent through whom the booking was made. If you cancel your holiday, cancellation charges are levied as follows (and apply where the balance of the price of the holiday is not paid by the date stipulated, but formal confirmation of cancellation has not been given in writing)
85 days or more before departure 50%
84 to 64 days before departure 60%
63 to 43 days before departure 70%
42 to 29 days before departure 80%
28 to 15 days before departure 90%
14 days or less before departure 100%
These percentages refer to the total holiday price. The 50% deposit will always be forfeited in full.
8.2 We reserve the right to cancel your holiday due to circumstances beyond our control. In this case all payments made to Bonefish Adventure for the holiday will be refunded. No compensation will be payable.
9 Changes to Holiday
We reserve the right at any time to substitute alternative accommodation or to make any other alterations to the holiday arrangements which become necessary due to circumstances beyond our control and undertake to inform you or your agent of any changes as soon as possible.
10 Responsibility
10.1 You are responsible for making yourself and all others in your group aware of the safety precautions necessary whilst fishing and must take all precautions as may be necessary to prevent or minimise any loss or injury to yourself or to others and must indemnify us against all liability arising from your failure to take such precautions.
10.2 Great care must be taken while driving in The Bahamas etc. No responsibility will be accepted by us for any loss or injury resulting from any accident, theft or breakdown involving any vehicle provided by us.
11 Catch & Release
We support Catch & Release. It is therefore a condition of booking that for the duration of the holiday you only use barb-less or de-barbed hooks, and release all bonefish and other game-fish unharmed as soon as possible after capture.
12 Etiquette/Smoking
You will be sharing accommodation, vehicles, and fishing locations with other anglers. You must therefore show due consideration to them at all times. We do not allow smoking inside the accommodation, restaurant or vehicles.
13 Complaints
If you have a problem during your holiday please inform us immediately so that we may have an opportunity to resolve it.
